The evidence has never been tested before.⁠ ⁠ Pervis is scheduled to be executed on Dec. 3, 2020, despite living with an intellectual disability that would make it unconstitutional to execute him.⁠ ⁠ “The court’s thoughtful and reasoned decision to order DNA testing in Pervis Payne’s case is just and in line with Tennessee’s clear DNA testing law," said Vanessa Potkin, Director of Post-Conviction Litigation at the Innocence Project and a member of Pervis' legal team.⁠ ⁠ "When DNA evidence exists in a death penalty case, as it does here, it should always be tested to avoid the irreversible act of executing an innocent man."⁠ ⁠ Pervis, a Black man, has been on death row for 33 years in Tennessee, where 51% of people on death row are Black.
